Mr L the claimant and also the passenger were heading towards MW10- Premier Park for work. They were exiting High Road in Finchley to go onto the A406. They were travelling slowly at the approximate speed of 5-10 mph. The claimant’s driver was slowing to stop at traffic lights when the third party car failed to observe and collided into the back of the claimants van. The claimant was sleeping at the time so he could not brace or anticipate the incident. He hit his knees on the dashboard.
Mr L visited accident and emergency the same day. An x-ray was taken, it showed no breakage but there was severe swelling and he could only put minimal pressure on his knee when walking. Mr L suffered severe swelling, pain, stiffness and discomfort in the right knee. His sleep and personal care were also restricted due to his injuries. He couldn’t go to the gym or play football, his walking was also restricted. Mr L decided to pursue a car accident claimand searched for personal injury solicitors in London to represent him. The third party insurers were contacted and they stated that they had not had an accident reported by their insured. The claim was put on the portal the third party insurers admitted liability but they didn’t confirm it on the portal so they didn’t respond within the allotted time.
Miss Manders of Clearwater Solicitors could not get a response from the third party after she submitted the medical report and she felt that legal proceedings should be issued.
– When the third party insurers were notified that legal proceedings were being issued they submitted a part 36 offer of £2750 but with no admission of liability.
– This was gladly accepted by Mr L. Therefore, on this occasion the third party insurers did not need to transfer the file to their personal injury solicitors as the claim was concluded before proceedings were issued.
